Our firm has a vast international experience of legal practice spanning over twenty years in various fields of law in government, civil society and private practice. Whereas the majority of our clients are individuals and organisations (governmental and nongovernmental) within and around Gauteng Province we nevertheless have a few foreign clients who have stayed with our firm for years.

Our principal director practised in Kenya as an advocate for several years before relocating to South Africa where he now practises as an attorney dealing in a variety of legal practice but mainly in immigration law, commercial litigation, personal injury, criminal law, human rights law and divorce matters. He is a member of the Law Society of the Northern Provinces and the Law Society of Kenya. His right of appearance in the High Court also obviates the need to brief counsel for appearances in certain matters or where the client cannot afford the services of such counsel. We are passionate in the delivery of quality service to all our clients in whatever mandate we have undertaken on our clients’ behalf whether on contingency basis or without it.

Commercial Law

We have a vast experience in litigation and advice on contracts of every kind or magnitude in the Republic and within regional areas. The world is getting smaller in this age of great advancement in technology where communication is instant and speed in completing deals is of the essence. In addition to incorporating companies, we also provide advice on mergers and acquisitions and shareholding thereof.

It is now essential not just to get in- house advice before signing many commercial contracts but also to obtain such advice from an independent source with experience in the field or industry in question. We pride ourselves with knowledge of commercial contracts in several spheres of business. Unfortunately, many companies fail soon after commencing business for various reasons but chiefly due to mismanagement and “biting more than it can chew” and are liquidated.

We offer advice on the provisions of the recent legislation regarding business rescue and compliance. We also offer advice on compliance with the Consumer Protection Act, National Credit Act and other recent legislations dealing with the conduct of business in the country. We have on many occasions provided legal advice to State Owned Enterprises as well as conducting litigation on their behalf. Nevertheless, we have also defended a large number of people against lawsuits by these companies and local authorities seeking compliance with their byelaws.

These legal battles often seem like David and Goliath encounters wherein one’s conscience is torn apart between upholding the rule of law at the expense of an individual’s or groups’ socio-economic and human rights and self-determination. However, on scrutiny oftentimes these rights are intertwined and complementary to one another.

Immigration Law

After the recent changes to the Regulations to the Immigration Act 13 of 2002 many immigrants and employers desirous of employing skilled foreign workers have experienced tremendous difficulties in obtaining the necessary visas. The same difficulties are faced by relatives wanting to accompany their loved ones in the country. Our practice is at the forefront in providing skilled expertise in the application and appeal where necessary of these visas. We assist big and small companies in processing the applications of the staff they wish to employ in compliance with the Act and to renew such visas if necessary. However, the majority of the cases are individuals, who want to live, work or join their relatives in the country who need assistance in compiling the requirements and submitting the same.

We are also prepared to take up applications to the High Court where necessary challenging unfair decisions or delay in making such decisions by the Home Affairs authorities. Advice on the category of visas available and the most suitable by virtue of qualification or status is often necessary before one embarks on these applications. With the advent of VFS Global and the need to apply online such applications now seem more complicated to a large number of people and require some skill, time and experience for which many people don’t have time or inclination to learn. Of late there has been a trend to reject applications on the most whimsical of reasons and without any foundation in law.

Since the inception of these changes have constantly brought applications challenging the constitutionality of some of the provisions contained in both the Act and the Regulations. Our practice has identified a number of sections in these pieces of legislations crying out for challenge before the Constitutional Court. Unfortunately, most applicants either do not have the time or the resources to litigate against the government to impugn these laws. It is hoped that the Immigration Advisory Board created in terms of section 4 of the Act will sit in due course and review some of these laws complained of.

Family & Personal Law

We offer advice and litigation on divorce, maintenance, estates, guardianship, care of children and marriage regime change. Although the Regional Courts offer some assistance, on these matters, it is often insufficient for a thorough and informed ventilation of the issues at stake and it is time consuming without legal assistance. We have on occasion have had to do it pro bono to prevent miscarriage of justice. It is an area of law in dire need of Legal Aid assistance, which currently offers legal aid on criminal cases only.

Criminal Law

We have frequently offered our services pro bono in some criminal cases where some applicants have failed the means test to qualify for Legal Aid Board assistance especially where we have thought a miscarriage of justice was likely to occur or when we have been asked to

A large number of the criminal cases appearing before our courts are of petty crime especially assault and theft. Though we would not often avail our services for these kinds of cases there are sometimes special cases where the suspects are either minors or from poor backgrounds and without the benefit of parental authority from an early age. But we have taken on major cases as well requiring a great deal of time and skill.

Labour Law

We provide legal opinions to small and medium sized enterprises on the compliance of the Labour Relations Act, requirements in disciplinary issues as well as compliance with a whole range of labour related legislation enacted after the new dispensation to redress historical imbalances and injustices that promote equity and transformation in society.

Individual cases are of particular importance to our firm owing to the uneven strengths of the parties involved leaving such individuals vulnerable to overwhelming resources which can be employed against them for a considerable length of time while such persons have limited resources to litigate for any length of time. These are not the only areas we specialise in and when a need arises depending on the intricacy of the law involved, we delve into such areas and if necessary, seek counsel from others with greater skill than ourselves.
